A 1010 WINS news reader lost his $2 million defamation case against his blogging Hoboken neighbors — and he may now have to pay their legal fees.
A Hudson Court Superior Court judge tossed the Lane Bajardi's case mid-trial, sending jurors home earlier this week even before the two local gadflies he'd sued had presented their defense.
In the original lawsuit, Bajardi and his wife, freelance broadcast journalist Kim Cardinal, had accused Hoboken zoning board member Nancy Pincus and another local blogger, Roman Brice, of defaming them in posts to the Hoboken Patch and Grafixavenger.blogspot.com during 2011 and 2012.
The anchor had alleged Pincus defamed him by calling him a bad dad and claiming he had been under federal investigation. Those and most of the suit's other alleged defamations were tossed last September when a judge in Jersey City ruled they were too old, or were only opinions, parodies or exaggerations.
The four surviving defamation counts went to trial last week. Those counts concerned posts in which the defendants accused Bajardi of being an anti-Semitic political operative of Hoboken councilwoman Beth Mason, and of conspiring to steal emails that had been sent to Hoboken Mayor Dawn Zimmer.
Those last counts were dismissed with prejudice this week by a Jersey City judge after Bajardi's side rested its case. Bajardi had failed to prove in his direct case that the blogs had been posted with actual malice, or that there were monetary or reputational damages suffered.
"There will be a motion for legal fees based on the filing of frivolous counts within the complaint," Pincus lawyer Stephen Katzman said Friday.
Bajardi and his wife could not be reached for comment Friday; they told the Hudsoncountyview.com they will appeal.
