There's a rumbling from the corporate graveyard — Barry Diller's Aereo is trying to come back from the dead.
After being deep-sixed by the Supreme Court in June for violating broadcast TV stations' copyrights, Aereo, which used tens of thousands of dime-sized antennas to redistribute local stations without paying for the signal, is looking to come back to life, CEO Chet Kanojia wrote in a blog post on Monday.
This time — if there is a this time — Aereo wants to be considered part of the cable TV universe.
Kanojia met on Oct. 8 with Federal Communications Commission boss Tom Wheeler to discuss a possible reclassification, the CEO wrote in the post.
Should the FCC side with Aereo, it would allow the nimble startup, backed by Diller and Highland Capital, to negotiate to carry local TV stations.
The first step on Aereo's comeback will play out at a hearing before Manhattan federal court Judge Alison Nathan on Oct. 15.
Part of Aereo's pitch to the FCC also involves its desire to carry only local stations and not be burdened by the huge packages that traditional operators take as part of bundled deals with programmers.
"[T]aking a bundle of broadcast and cable channels in retransmission consent negotiations could harm the economic viability of online streaming services," Aereo said in a court filing.
That notion will no doubt raise eyebrows among cable operators that would love to have the same choice: to cherry-pick what they carry.
"We believe that clarifying [our classification] to narrowly include linear online video services like Aereo's would have clear benefits to consumers, creators and distributors alike," the CEO wrote.
Broadcasters feel that Aereo has had many opportunities to pay up and act like regular distributors, but that it has avoided that route time and time again.
Still, if Aereo is willing to add to network retransmission coffers, they're welcome to join the party, sources told The Post.
